Welcome to DubaiElevate. These Terms and Conditions ("Terms") govern your use of the DubaiElevate website (dubaielevate.com) and the services offered through it, including booking premium Dubai experiences.

By accessing our website, registering for an account, or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

We may modify these Terms at any time. Your continued use of our website and services after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.

1. Definitions

In these Terms, the following definitions apply:

  • "We," "our," "us," or "DubaiElevate" refers to DubaiElevate, Company Registration No. 33187228, with its principal place of business at 7 Martin Square, New Dylan, PH6 2HW, United Kingdom.
  • "You" or "your" refers to the person accessing or using our website and services.
  • "Website" refers to the website operated by DubaiElevate at dubaielevate.com and any related pages or services.
  • "Services" refers to the services provided by DubaiElevate, including booking and facilitating premium experiences in Dubai.
  • "Experience" refers to any activity, venue access, or service that you book through our Website.
  • "Experience Provider" refers to the third-party venue, operator, or supplier who provides the actual Experience.
  • "Booking" refers to the reservation of an Experience through our Website.

2. Account Registration

2.1 Account Creation: To make a booking, you may need to create an account. You must provide accurate, current, and complete information during the registration process and keep your account information updated.

2.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

2.3 Age Restriction: You must be at least 18 years old to create an account and make bookings through our Website. By creating an account, you represent and warrant that you are at least 18 years old.

2.4 One Person, One Account: Each person may maintain only one active account. We reserve the right to terminate duplicate accounts.

3. Booking Process

3.1 Making a Booking: By making a booking through our Website, you enter into a contractual relationship with us and, where applicable, with the Experience Provider.

3.2 Booking Confirmation: A booking is not confirmed until you receive a booking confirmation email from us. We reserve the right to decline or cancel bookings at our discretion.

3.3 Accuracy of Information: You must ensure that all information provided during the booking process is accurate and complete, including contact details, participant names, and special requirements.

3.4 Booking for Others: If you make a booking on behalf of others, you warrant that you have the authority to accept these Terms on their behalf, and that they will comply with these Terms.

3.5 Special Requirements: Any special requirements (e.g., dietary restrictions, accessibility needs) must be communicated at the time of booking. While we will make reasonable efforts to accommodate such requirements, we cannot guarantee that all requests will be fulfilled.

4. Prices and Payment

4.1 Pricing: All prices displayed on our Website are in US Dollars (USD) and include applicable taxes unless otherwise stated. Prices are subject to change without notice until your booking is confirmed.

4.2 Payment Methods: We accept payment via credit/debit cards (Visa, Mastercard, American Express) and PayPal. By providing payment information, you represent and warrant that you have the legal right to use the payment method provided.

4.3 Payment Timing: Full payment is required at the time of booking unless otherwise specified. For certain high-value Experiences, we may require a deposit with the balance due before the Experience date.

4.4 Payment Security: All payment transactions are processed through secure and encrypted third-party payment processors. We do not store your complete payment information on our servers.

4.5 Currency Conversion: If your payment card is denominated in a currency different from USD, the final amount charged to your card may vary due to exchange rate fluctuations and any conversion fees imposed by your card issuer.

5. Cancellations and Modifications

5.1 Cancellation by You: Our standard cancellation policy allows for:

  • Full refund if cancelled more than 48 hours before the scheduled Experience.
  • 50% refund if cancelled between 24-48 hours before the scheduled Experience.
  • No refund if cancelled less than 24 hours before the scheduled Experience.

However, some Experiences may have different cancellation policies, which will be clearly indicated during the booking process and in your booking confirmation.

5.2 Modification by You: Requests to modify bookings (e.g., change of date, time, or number of participants) must be made at least 48 hours before the scheduled Experience and are subject to availability. Modification fees may apply.

5.3 Cancellation or Modification by Us: We reserve the right to cancel or modify bookings due to circumstances beyond our control (including but not limited to weather conditions, venue closure, safety concerns) or if the minimum number of participants is not reached. In such cases, we will offer you the choice of an alternative Experience, rebooking for another date, or a full refund.

5.4 No-Show: If you fail to attend an Experience without prior notification ("no-show"), you will not be entitled to any refund.

5.5 Refund Processing: Approved refunds will be processed using the original payment method and may take up to 14 business days to appear in your account, depending on your payment provider's policies.

6. Experience Participation

6.1 Confirmation and Vouchers: Upon successful booking and payment, you will receive a confirmation email with details of your Experience and, where applicable, electronic vouchers. You must present these vouchers (either printed or on a mobile device) at the Experience venue.

6.2 Identification: You may be required to present valid identification matching the name on the booking at the Experience venue.

6.3 Arrival Time: You must arrive at the Experience venue at the specified time. Late arrival may result in denied entry without refund, particularly for time-sensitive Experiences.

6.4 Rules and Regulations: You must comply with all rules, regulations, and instructions provided by the Experience Provider, including but not limited to safety protocols, dress codes, behavior guidelines, and photography restrictions.

6.5 Age and Health Restrictions: Some Experiences have age, height, weight, or health restrictions. It is your responsibility to ensure that all participants meet these requirements. We reserve the right to refuse participation, without refund, if these requirements are not met.

6.6 Behavior: You must behave in a respectful and appropriate manner during the Experience. We and the Experience Provider reserve the right to terminate your participation, without refund, if your behavior is disruptive, inappropriate, or poses a risk to yourself or others.

6.7 Personal Belongings: You are responsible for your personal belongings during the Experience. Neither we nor the Experience Provider accept liability for any loss, theft, or damage to personal property.

7. Website Use

7.1 License: We grant you a limited, non-exclusive, revocable license to access and use our Website for personal, non-commercial purposes.

7.2 Prohibited Activities: You agree not to:

  • Use our Website for any unlawful purpose or in violation of these Terms.
  • Use our Website in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the site.
  • Use any robot, spider, or other automatic device, process, or means to access our Website for any purpose, including monitoring or copying any of the material on our Website.
  • Use any device, software, or routine that interferes with the proper working of our Website.
  • Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of our Website, the server on which our Website is stored, or any server, computer, or database connected to our Website.
  • Attack our Website via a denial-of-service attack or a distributed denial-of-service attack.

7.3 User Content: If you submit reviews, comments, or other content to our Website, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media. You represent and warrant that such content is accurate, does not violate any third-party rights, and complies with all applicable laws.

8. Intellectual Property

8.1 Ownership: Our Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by DubaiElevate, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

8.2 Trademarks: DubaiElevate, our logo, and all related names, logos, product and service names, designs, and slogans are trademarks of DubaiElevate or its affiliates or licensors. You must not use such marks without our prior written permission.

8.3 No License: Nothing in these Terms grants you any right, title, or interest in our Website, our content, or our intellectual property.

9. Limitation of Liability

9.1 Role as Intermediary: We act as an intermediary between you and the Experience Providers. While we carefully select our Experience Providers and strive to ensure the quality and safety of all Experiences, we are not responsible for the conduct, actions, or omissions of Experience Providers or other third parties.

9.2 Disclaimer of Warranties: Our Website and services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

9.3 Limitation of Liability: To the maximum extent permitted by law, DubaiElevate, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use our Website or services;
  • Any conduct or content of any third party on our Website or services;
  • Any content obtained from our Website or services; and
  • Unauthorized access, use, or alteration of your transmissions or content.

9.4 Liability Cap: In no event shall our total liability to you for all claims arising from or related to your use of our Website or services exceed the amount paid by you to DubaiElevate for the specific Experience giving rise to such liability.

9.5 Exclusions: Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. Therefore, some of the above limitations in this section may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless DubaiElevate, its directors, employees, partners, agents, suppliers, and affiliates, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our Website or services, including, but not limited to, any use of our Website's content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from our Website.

11. Third-Party Links and Content

11.1 Third-Party Links: Our Website may contain links to third-party websites or services that are not owned or controlled by DubaiElevate. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

11.2 Use of Third-Party Links: You acknowledge and agree that DubaiElevate shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

11.3 Third-Party Content: We may display content from third parties on our Website, including user reviews, descriptions of Experiences, and information about Experience Providers. We do not guarantee the accuracy, completeness, or usefulness of this content, and we are not responsible for any errors or omissions in such content.

12. Governing Law and Dispute Resolution

12.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

12.2 Dispute Resolution: Any disputes arising out of or relating to these Terms, our Website, or our services shall be resolved as follows:

  • Informal Resolution: We encourage you to contact us first to seek an informal resolution of any dispute.
  • Mediation: If informal resolution is unsuccessful, the parties agree to attempt to resolve the dispute through mediation before a mutually agreed mediator.
  • Legal Proceedings: If mediation is unsuccessful, either party may commence legal proceedings. The courts of the United Kingdom shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.

12.3 Time Limitation: Any claim arising out of or related to these Terms must be brought within one (1) year after the cause of action arises.

13. General Provisions

13.1 Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and DubaiElevate regarding your use of our Website and services.

13.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.

13.3 Waiver: No waiver of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

13.4 Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without your consent.

14. Force Majeure

Neither party shall be liable for any failure or delay in performance of its obligations under these Terms where such failure or delay results from any cause that is beyond the reasonable control of that party. Such causes include, but are not limited to, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, national emergency, pandemic, epidemic, lockout, strike or other labor dispute, or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials.

15. Consumer Rights

Nothing in these Terms shall affect your statutory rights as a consumer. For information about your legal rights, contact your local consumer protection authority.
